Equipment Hire Terms and Conditions

Sunshine Coast Small Plant Hire

These Terms & Conditions apply to all equipment hire, wet hire services, enquiries and use of this website provided by Sunshine Coast Small Plant Hire (“we”, “us”, “our”).

By hiring equipment, engaging our services, or making an enquiry, you agree to be bound by these Terms & Conditions.

1. Definitions
 

  • Hirer means the person or entity hiring equipment or engaging services.

  • Equipment includes all plant, machinery, attachments and accessories supplied by us.

  • Wet Hire means equipment supplied with an operator.

  • Dry Hire means equipment supplied without an operator.

2. Hire Basis

We offer both wet hire and dry hire, subject to availability and suitability.

  • Dry hire is available to experienced operators only.

  • We reserve the right to refuse dry hire where the hirer is deemed inexperienced or where site conditions are unsuitable

3. Hire Period

  • The hire period commences when equipment is delivered, collected, or made available for use.

  • The hire period ends when the equipment is returned and inspected, or when wet hire services conclude.

  • Late returns may incur additional charges.

4. Payment Terms

  • Payment terms will be agreed prior to hire.

  • All hire fees must be paid in full unless otherwise agreed.

  • Additional charges may apply for:

    • Damage

    • Excessive cleaning

    • Fuel replacement

    • Late return

    • Loss of equipment or attachments

5. Delivery & Collection

  • Delivery and collection may be available by arrangement.

  • The hirer is responsible for ensuring suitable access and safe delivery conditions.

  • Any delays caused by site access issues may incur additional charges.

6. Condition of Equipment

  • Equipment is supplied in good working condition.

  • The hirer must inspect the equipment on delivery or collection and report any issues immediately.

  • Continued use of the equipment is deemed acceptance of its condition.

7. Use of Equipment (Dry Hire)

The hirer agrees that:

  • Equipment will only be used for its intended purpose.

  • Equipment will be operated in a safe and competent manner.

  • All workplace health and safety obligations are complied with.

  • Equipment will not be modified, repaired or altered.

  • Equipment will not be used for unlawful or unsafe purposes.

Trailer Supply & Tow Vehicle Requirements

Where the mini excavator is supplied with a trailer for collection from Landsborough, the Hirer acknowledges and agrees that:

  1. The Hirer’s tow vehicle must be legally rated and suitable to tow up to 3,500 kg, including:

    • Manufacturer-rated towing capacity

    • Compliant tow bar

    • Operational electric brake controller or approved braking system

    • Roadworthy condition

  2. The supplied trailer is fitted with a Bluetooth-operated electric braking system, which requires the Hirer to have:

    • A compatible smartphone available at the time of pickup

    • The required application installed and operational prior to departure

  3. The Hirer is responsible for ensuring:

    • All connections are correctly fitted and operational

    • Braking system is functioning correctly before transport

    • The load is transported in compliance with all road laws

  4. The Owner reserves the right to refuse hire or prevent collection if, in the Owner’s reasonable opinion:

    • The tow vehicle is unsuitable or non-compliant

    • The braking system cannot be correctly operated

    • The Hirer is unable to demonstrate safe and lawful towing capability

  5. Any refusal of hire on the basis of vehicle suitability or safety does not constitute a breach by the Owner. Cancellation  or rescheduling will be assessed on a case-by-case basis.

8. Wet Hire

  • All wet hire work is carried out by a licensed and insured operator.

  • We reserve the right to refuse or stop work if conditions are unsafe.

  • Wet hire is subject to site suitability, access and weather conditions.

  • Cable and/or Pipe location services must be undertaken before digging commences. (at the hirers Expense)

  • The site controller / client is responsible for:

    • *Providing a suitable spotter when required * (see below)

    • Site access and exclusion zones

    • Identifying services and hazards

      *  Where a spotter or observer is required for safe operation, it is the responsibility of the site controller or hirer to provide a suitably competent person, unless otherwise agreed in writing

9. Attachments & Accessories
 

  • Attachments supplied may include buckets, augers, grabs, rippers, sieve buckets and lifting devices.

  • Not all attachments are suitable for all tasks.

  • Attachment suitability is assessed at our discretion.

  • Certain attachments may be wet hire only.

10. Damage, Loss & Cleaning

  • The hirer is responsible for loss of or damage to equipment during the hire period (excluding fair wear and tear).

  • Equipment must be returned clean and refuelled 

  • Excessive cleaning, damage or repairs will be charged to the hirer.

11. Liability & Indemnity

  • To the extent permitted by law, we are not liable for any loss, damage, injury or delay arising from the hire or use of equipment.

  • The hirer indemnifies us against all claims, losses, damages and costs arising from the use of the equipment.

  • Nothing in these terms excludes rights under Australian Consumer Law.

12. Cancellations

  • Cancellations must be made as early as possible.

  • Late cancellations or no-shows may incur a fee.

  • Wet hire cancellations due to weather are assessed on a case-by-case basis.

13. Workplace Health & Safety

  • The hirer is responsible for ensuring a safe work environment.

  • We comply with Queensland WHS legislation.

  • We may cease work immediately if unsafe conditions exist.

14. Privacy

Any personal information collected is handled in accordance with our Privacy Policy and Australian privacy laws.

15. Governing Law

These Terms & Conditions are governed by the laws of Queensland, Australia.

16. Acceptance

By hiring equipment or engaging our services, the hirer acknowledges that they have read, understood and agree to these Terms & Conditions.
